The New York data center moratorium that state legislators had been pushing for months arrived not from the legislature but from the governor’s desk. Gov. Kathy Hochul signed Executive Order No. 62, formally titled ‘Establishing a Temporary Moratorium on Data Centers in New York While State Develops Environmental Review Process,’ making New York the first state in the country to halt permitting for large new data centre facilities.
The order bars the state’s Department of Environmental Conservation (DEC) from issuing discretionary permits for data centres of 50 megawatts or larger, provided those permit applications were not already determined to be complete before the order took effect. Projects that require no discretionary DEC approvals are exempt entirely.
What the New York Data Center Moratorium Actually Requires
The order goes further than a simple permit freeze. It directs the Department of Public Service (DPS) to launch a formal public process, including public comment periods and a public hearing, to produce a Generic Environmental Impact Statement under the State Environmental Quality Review Act. That review must assess energy demand, water use and quality, air quality, noise levels, and potential disproportionate impacts on disadvantaged communities.
The DPS has also been directed to convene the state’s transmission owners and, within 90 days, report back on how they study the grid impacts of data centres. That deadline reflects how urgently grid capacity has become a live concern: data centres in development are expected to dwarf those built even a few years ago, with Phillips Lytle noting that the Federal Energy Regulatory Commission had separately ordered the New York Independent System Operator and state transmission owners to review and justify their interconnection practices for large loads.
Hochul has said the moratorium will be lifted once the environmental review is complete, a process she expects will take roughly a year. Her office is also weighing a requirement that data centres contribute to a fund supporting the state’s electrical grid, and she has signalled interest in blocking hyperscale facilities from receiving tax benefits.
The Legislative Backdrop: A Lower Bar That Was Rejected
The timing is not coincidental. Hodgson Russ reports that the executive order followed discussions between Hochul and the legislature after lawmakers passed the Responsible Data Center Development Act (S10642/A11560). That bill would have imposed a one-year permitting pause on data centres consuming 20 megawatts or more, a considerably lower threshold than the 50 MW line Hochul drew in her executive order. A separate bill, still in committee, would institute a three-year moratorium.
By acting through an executive order rather than waiting for legislation, Hochul retained more control over the shape of the pause, including the higher 50 MW threshold and the environmental review mechanism.
‘Progress shouldn’t arrive with a higher utility bill, deleted water supply, or noise pollution,’ Hochul said at a press conference in Brooklyn. ‘These data centers can only be built, should only be built in places that want them. So they will never be exempt from local zoning, local approvals.’
Public Anxiety Over AI Is Part of the Calculation
The moratorium sits inside a broader shift in how Americans feel about the infrastructure underwriting artificial intelligence. A Pew Research Centre survey found that only 10% of Americans were more excited than concerned about AI use in daily life, and just 23% felt the technology would have a positive impact on how people do their jobs. Less than a quarter believed AI would give the economy a boost; fewer than a third were confident the government would regulate it responsibly.
The same Pew Research Center research found that 53% of US adults believe increased AI use will worsen people’s ability to think creatively, compared with just 16% who think it will improve that ability. Against that backdrop, the physical footprint of AI computing, rising electricity demand, water consumption, noise, and encroachment on farmland, has become a concrete political grievance.
Two-thirds of respondents to a recent poll said they were concerned about data centres driving up electricity prices. A separate survey found that people would sooner have an Amazon warehouse nearby than a data centre. Those sentiments have changed the political economics of a sector that, not long ago, states were competing to attract.
New York is not the only jurisdiction to have weighed action. More than 230 organisations called for a nationwide pause last December. Vermont Senator Bernie Sanders has proposed a federal moratorium, though it has gained little traction. Maine’s legislature passed a bill that would have paused construction until 1 November 2027, but Governor Janet Mills vetoed it. The appetite in Washington is moving in the opposite direction: the Federal Energy Regulatory Commission, led by a Trump appointee, last month directed grid operators to create fast-track interconnection lanes specifically for data centres.
The collision between a state-level pause and a federal push for speed is coming. According to BloombergNEF, nearly a quarter of new data centres built through 2030 will exceed 500 megawatts, driven by accelerating AI investment. Whether New York’s environmental review concludes before that pipeline hardens into committed capital is the question the moratorium’s one-year clock is really answering.
